Lex Koller — Navigating Swiss Property Restrictions

The acquisition of residential property in Switzerland by non-resident foreign nationals is governed by the Lex Koller legislation (Bundesgesetz über den Erwerb von Grundstücken durch Personen im Ausland). The applicable framework depends on the buyer's nationality, residency status, the canton, and the intended use of the property.

In designated tourist zones — Verbier, Zermatt, Gstaad, St. Moritz, Crans-Montana, Andermatt — non-resident foreign buyers may acquire a secondary residence subject to an annual cantonal quota. These quotas are limited and can be exhausted in high-demand years. In non-tourist zones such as Zurich, Zug, Geneva and Lausanne, non-resident foreign buyers face more significant restrictions on secondary residences and investment properties.

EU and EFTA nationals resident in Switzerland may generally acquire property without restriction. Non-EU/EFTA nationals resident in Switzerland with a valid permit (B or C) may generally acquire a primary residence without restriction. The Lex Koller position must be assessed before any purchase agreement is signed.
