Buying Property in London — Legal Framework & Tax
There are no restrictions on foreign nationals purchasing residential property in the United Kingdom. Any individual, regardless of nationality or residency status, may acquire property in England and Wales under English law. There is no equivalent of the Swiss Lex Koller legislation.
The principal tax consideration for international buyers is Stamp Duty Land Tax (SDLT). Non-UK residents purchasing residential property are subject to a 2% surcharge on top of the standard SDLT rates, which themselves increase significantly above £250,000. For a property purchased at £5 million, the total SDLT liability for a non-UK resident individual can exceed £600,000. Buyers acquiring through a company structure are subject to the Annual Tax on Enveloped Dwellings (ATED) and a flat 15% SDLT rate on residential properties above £500,000.
The acquisition process in England and Wales follows English common law. Once a price is agreed, solicitors are instructed on both sides.
